Distinctive Reborns & or Distinctive Reborn Supplies Terms and Conditions of sale
Distinctive Reborns & Distinctive Reborn Supplies, established in 2007, a supplier / reseller of Reborn materials, supplies, tools and accessories associated with the art of reborning and doll collecting.
Distinctive Reborns & Distinctive Reborn Supplies, may wish to change the terms and conditions to reflect updates in the law or changes in products or services. Distinctive Reborns & Distinctive Reborn Supplies reserve the right to modify these terms and or conditions without notice and by use of this web site, you recognise that it is your responsibility to review these terms and conditions from time to time.
Terms and conditions
1. Orders
1.1. Goods are NOT sold on a sale or return evaluation basis. Please ensure you order carefully. Special orders of any products cannot be cancelled. Once ordered, goods have to be paid for in full
1.2. We reserve the right to refuse and or cancel any order, at any time without any reason.
1.3. You can cancel your order at any time up to the time of dispatch without penalty. However if you cancel and the goods have been dispatched to you, a 15% restocking fee will be charged, The buyer is responsible for all postage costs including returns.
2. How to order and payment terms
2.1. We cannot accept telephone orders.
2.2. Goods can only be purchased online at www.distinctive-reborn-supplies.co.uk
2.3. Goods can be ordered online to a maximum £500 unless previously agreed, for payment by credit card, cheque or bank transfer.
2.4. Please note that we perform a level of identity and credit card check to reduce the use of your card fraudulently, this does not in any way relieve you of your obligations indicated by your bank, credit card provider or banking merchants, to your said provider. Our check is to protect Distinctive Reborns & or Distinctive Reborn Supplies products from a fraudulent purchase.
2.5. Orders can only be accepted for delivery to your billing address, or Paypal verified address
2.6. When ordering goods, please ensure you order your goods well in advance in case of unforeseen events that may delay delivery. We will not be liable for any failure to effect delivery in any circumstances, foreseen or otherwise.
2.7 Property in all goods supplied does not pass to the buyer until after full payment has been received and cleared.
2.8 Distinctive Reborns & or Distinctive Reborn Supplies reserve the right to change the prices without notice.
3. Delivery and checking of goods
3.1. All goods will be subject to availability.
3.2. Once delivered goods cannot be exchanged or returned.
3.3. Delivery dates are given in good faith. We will not be liable for any failure to effect delivery of the whole or part of any order due to any events, errors or any other circumstances. If delivery is delayed we will notify you as soon as we are aware of the delay and you agree to give us such an extension to effect delivery as is reasonable in the circumstances.
3.4. Goods MUST be checked for physical damage before signing to accept delivery from the courier. If the goods are damaged or broken, please DO NOT sign for the goods. Contact Distinctive Reborns & or Distinctive Reborn Supplies immediately by email at distinctive.reborns@talktalk.net. When signing for acceptance of your goods, you are signing to accept ownership of your goods in perfect physical condition. If you do not check the goods at time of signing, and the goods have been broken in transit, you will forfeit your right to reject the goods for physical damage and we cannot replace or take back your goods.
3.5. Once you have accepted your goods, please note you have 2 working days to check that your product are satisfactory. Please inspect your goods very carefully within these two working days. In the unlikely event that, for example a doll kit has a blemish, please, if possible, photograph the blemish and send the image to distinctive.reborns@talktalk.net In such case or should the goods not work satisfactorily you must contact us to obtain a returns number, providing the goods are undamaged (accidental), unused, and in their original packing and you have not marked either the goods or their packing in any way. If you fail to comply with these terms you will be deemed to have accepted the goods.
3.6 Goods returned in undamaged, unused condition and in their original packing which has not been defaced in any way, will be inspected by Distinctive Reborns or Distinctive Reborn Supplies and or the by manufacturer, a replacement or return of your goods will be made based on their decision. A charge may be incurred, however Distinctive Reborns & or Distinctive Reborn Supplies will endeavour to keep it to a minimum.
3.7 After two working days, the manufacturers warranty comes into effect. Please note goods are NOT sold on a sale or return basis.
3.8 Distinctive Reborns & or Distinctive Reborn Supplies will not be responsible for any labour charges, rental charges, loss of profits, charges, expenses, any other charges, loss nor consequential loss or damage as a result of delivery delays, incorrect goods or defective goods being delivered to its customers.
4. Quality of goods
4.1. We warrant that (subject to the other provisions in these conditions) the goods will be of satisfactory quality.
4.2. As we are not the manufacturer of the goods, all warranties, conditions and other terms implied by statute or common law (except as to title) are, subject to above, expressly excluded. However, we will endeavour to pass on to you the benefit of any warranty or guarantee given by the manufacturer in respect of the goods.
5. Description of goods
5.1. Description of goods on the website is given for the purpose of providing information on manufacturers goods. Such goods are liable to change in specification by the manufacturers without any notice.
5.2. Although every care is given to providing accurate descriptions and pricing on the website we cannot be held responsible for any incompleteness, errors or omissions. E.&O.E
5.3. Product guides or tips are produced by Distinctive Reborns & or Distinctive Reborn Supplies for the sole purpose of providing general information. No liability can be accepted for the completeness or accuracy of these guides or tips.
5.4. Distinctive Reborns & or Distinctive Reborn Supplies take no responsibility for any problems or accidents resulting from use of materials, tools, equipment or any other product purchased or not purchased form Distinctive Reborns & or Distinctive Reborn Supplies . It is recommended that any purchaser / buyer / end user, should seek professional assistance from a qualified or other competent person before using any product sold by Distinctive Reborns or Distinctive Reborn Supplies.
6. Warranties
7. Force majeure
7.1. Distinctive Reborns & or Distinctive Reborn Supplies is / are not liable for delays in delivery or cancellation of your order caused by circumstances beyond its reasonable control. Examples are supplier transport, manufacturers production problems, governmental action and natural disasters. If this lasts for more than two months, then the contract may be terminated by either party without compensation.
8. Contract
8.1. The Contract shall be governed by the laws of England and the parties shall submit to the sole jurisdiction of the English courts.
9. Data Protection
9.1 Distinctive Reborns & or Distinctive Reborn Supplies may collect personal information while completing the checkout process. This is solely (except 9.2) to enable Distinctive Reborns & or Distinctive Reborn Supplies to process your order of goods supplied by Distinctive Reborns & or Distinctive Reborn Supplies. Distinctive Reborns & or Distinctive Reborn Supplies assures all it's customers that this data will never be knowingly passed to a third party, and guarantee this data will never be sold by Distinctive Reborns & or Distinctive Reborn Supplies to any third parties.
9.2 By accessing and or use of this web site, you are agreeing to Distinctive Reborns & or Distinctive Reborn Supplies, from time to time, providing you with information and/or offers of sale of goods from this web site. We always pursue issues if copyright infringements and theft and take this issue VERY seriously. We will endeavour to recover the material stolen and all legal costs, business losses, personal losses and compensation, from anyone that makes and infringement of copyright law.
11. Indemnification
Customer agrees that it shall defend, indemnify, save and hold Distinctive Reborns & or Distinctive Reborn Supplies harmless from any and all demands, liabilities, losses, costs and claims, including reasonable solicitor's or attorney's fees asserted against Distinctive Reborns & or Distinctive Reborn Supplies, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Distinctive Reborns & or Distinctive Reborn Supplies against liabilities arising out of: (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Distinctive Reborns & or Distinctive Reborn Supplies. (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party. (3) copyright infringement. (4) any defective products sold to customer by Distinctive Reborns & or Distinctive Reborn Supplies.
Distinctive Reborns & or Distinctive Reborn Supplies reserves the right to revise the above mentioned policies, terms and conditions at any time.
